Your acceptance of products purchased from Akkula constitutes acceptance of Akkula's standard warranty terms and conditions, which are described below.

Warranty Terms

Akkula Group. ("Akkula") warrants that for a period of two (2) years following delivery, the Akkula products you have purchased (the "Akkula Products") will (a) perform in accordance with published specifications, and (b) will be free from defects in materials or workmanship. In the event a Akkula Product does not meet this warranty, subject to the conditions set forth in these terms and conditions, Akkula's sole obligation will be, at its election, to repair or replace the Akkula Product in question or to refund the purchase price.

AKKULA MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED, AND ALL IMPLIED WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT AND FITNESS FOR A PARTICULAR PURPOSE ARE HEREBY DISCLAIMED. IN NO EVENT WILL AKKULA BE LIABLE FOR PUNITIVE, SPECIAL OR CONSEQUENTIAL DAMAGES, OR FOR AN AMOUNT IN EXCESS OF THE PURCHASE PRICE OF THE DEFECTIVE AKKULA PRODUCT OR PRODUCTS.

This warranty will not apply to any Akkula Products that have been (a) damaged by lightning, water, or power surges, (b) neglected, altered, abused, or used for a purpose other than the purpose for they were provided, (c) repaired by you or any other party without Akkula's prior written authorization, (d) used in conjunction with a third party product or products not approved in advance by Akkula, or (e) otherwise used in a manner inconsistent with any instructions provided by Akkula.

In the event that Akkula repairs or replaces a defective Akkula Product under warranty, the repaired or replaced product will be covered through the end of the original warranty period, but no repair or replacement will extend the warranty term past the two (2) year anniversary of the delivery date of the original Akkula Product.

This warranty contains the entire agreement of you and Akkula with respect to any warranty matters, and supersedes any and all other written or oral statements, representations or agreements relating to the subject matter of this warranty, except that (if applicable) the terms and conditions of any other warranty or service agreement between you and Akkula that explicitly supplements or incorporates, and does not replace or modify, the terms and conditions of this warranty will also apply to the Akkula Products you have purchased. To the extent any other warranty or service agreement between you and Akkula expressly replaces or modifies the terms and conditions of this warranty, such replaced or modified terms shall not apply unless accepted by you (or your distributor, if applicable) and Akkula in a signed writing (e.g., the Extended Warranty Services Agreement). You should note that if you are interested in obtaining either an extended warranty or an extended warranty with overnight replacement service, you must notify Akkula of the same and execute an agreement specified by Akkula within 60 days of your purchase of the Akkula Products for which you are seeking coverage. If you purchased the Akkula Products from a party other than Akkula, Akkula reserves the right to require proof of purchase to verify the timeliness of your request.

Any and all disputes arising out of or relating to the purchase or use of Akkula

Products, including any warranty claims, will be governed by the laws of the United Kingdom without regards to conflicts of laws principles. Any action arising out of or relating to the Akkula Products must be brought only the Civil courts located in England, and by accepting the Akkula Products, you hereby consent to the personal jurisdiction of such courts and agree not to raise any argument of lack of personal jurisdiction or inconvenient forum or otherwise attempt to transfer such action from, or dispute the jurisdiction of, such courts. YOU HEREBY WAIVE THE RIGHT TO A JURY TRIAL.

Return Procedures

You are required to arrange for and pay the shipping charges to return any defective Akkula Products to Akkula. Akkula will use commercially reasonable efforts to repair the defective Akkula Products within ten (21) business days. Akkula will arrange for and pay ground shipping charges for all products replaced or returned to you within the United Kingdom. Any other shipping charges are your responsibility. Akkula does offer on-site service to repair any defective Akkula Products or to resolve any problems relating to the installation of repaired or replacement products. Akkula will, however, provide on-line support and troubleshooting.

In the event that service is required, products may be shipped, freight prepaid, to our Nevada State factory:

A Returned Materials Authorization (RMA) is not required. Return shipping charges (surface) will be paid by Akkula to destinations in U.S. and Canada.

Please include, inside the shipping box, a description of the problem, a return shipping address (must have street address, not P.O. Box), and your telephone number. If the product is out of warranty, a payment in advance is required. Acceptable means of payment include credit card, wire transfer or a check in U.S. dollars drawn on a U.S. Bank.

Out-of-warranty repairs will be charged according to the Schedule of Fees, which may be obtained by emailing Repairs.

Extended Warranty Service Plans are available for selected products. Please call our sales department at or visit the Services page for details on rates and coverage.

Questions regarding technical matters, product configuration, verification that the product is defective, etc., should be directed to our Technical Support department.

Please direct your questions regarding repair expediting, receiving, shipping, billing, etc., to our Repair department. Repairs for damages caused by lightning storms, water, power surges, incorrect installation, physical abuse, or user-caused damages are billed on a time-plus-materials basis.

Repair Procedures for International Customers

(Outside U.S.A. and Canada)

Your original point-of-purchase Reseller may offer the quickest and most economical repair option for your Akkula product. You may also contact the United Kingdom AKKULA Head Office for information about the nearest distributor or other repair service for your Akkula product.

In the event that factory service is required, products may be shipped, freight prepaid to our United Kingdom factory. Recommended international shipment methods are via Federal Express, UPS or DHL courier services, or by air freight; shipments made by any other method will be refused.

Please include, inside the shipping box, a description of the problem, a return shipping address (must have street address, not P.O. Box), and your telephone number. If the product is out of warranty, a payment in advance is required. Acceptable means of payment include credit card, wire transfer or a check in UK. Pounds drawn on a European Bank. Repaired units shall be shipped freight collect, unless other arrangements are made in advance.

International distributors should contact their AKKULA GROUP sales representative for information about the repair of AKKULA product(s).

When calling the U.S or U.K., please direct your questions regarding repair expediting, receiving, shipping, billing, etc., to our Repair Accounting department or email our repairs department.
